Understanding Article 3 of the Turkish Industrial Property Code

1. 🇹🇷 Citizens of the Republic of Turkey
All Turkish citizens are automatically eligible for industrial property protection without any additional conditions.
2. 🏢 Persons or Entities with a Business or Legal Presence in Turkey
Anyone—regardless of nationality—who is either:
Domiciled in Turkey, or Engaged in industrial or commercial activities within Turkish territory, can benefit from the Code’s protections.
3. 🌍 Applicants Covered by International Agreements
Individuals or legal entities from countries that are parties to:
The Paris Convention for the Protection of Industrial Property, or The Agreement Establishing the World Trade Organization (WTO) are also entitled to protection under Turkish law.
4. ⚖️ Foreign Nationals Covered by Reciprocity
Citizens of countries that offer equivalent protection to Turkish citizens under their own laws can benefit from Turkish IP rights under the principle of reciprocity.
